A wrongful death action in Alabama must be commenced within two years from the date of death (Ala. Code § 6-5-410(d)). That is the outside limit, and it does not wait while the estate is opened, so probate should begin early.

Some deadlines are much shorter. A claim against the City of Birmingham or another municipality must be presented as a sworn claim within six months, and a claim against Jefferson County must be presented to the county commission within twelve months.
